1. Who we are
This website is operated by Marble Pantry, a brand of Scale Media LLC, 1621 Central Ave, Cheyenne, WY 82001, United States. Throughout this document "we", "us" and "our" refer to that entity. By visiting the site or buying from us you agree to these Terms of Service. If you do not agree, please do not use the site.
2. Eligibility
You must be at least the age of majority in your state or country of residence to place an order. You may not use our products for any unlawful purpose or in breach of any law in your jurisdiction.
3. Products, images and pricing
Product photography is supplied by our manufacturers and vendors and is intended to represent the item accurately. Colours can vary between screens. Dimensions and piece counts are as supplied to us. We may change, limit or discontinue any product at any time, and prices are subject to change without notice. Where a product is listed at an obviously incorrect price due to a typographical or system error, we may cancel the order and refund you in full rather than honour the error.
4. Orders and acceptance
Your order is an offer to buy. We accept it when we send the shipping confirmation, not when you pay. We may refuse or cancel any order, including orders that appear to be placed by resellers, orders flagged for fraud, and orders we cannot ship to your address. Cancelled orders are refunded in full.
5. Accuracy of your information
You agree to give current, complete and accurate billing and shipping information. Orders that fail address verification or that are undeliverable because of an incorrect address may incur reshipment costs.
6. Shipping, returns and refunds
Delivery timeframes, return conditions and refund mechanics are set out in our Shipping Policy, Returns & Exchanges policy and Refund Policy. Those documents form part of these Terms.
7. Product use and safety
Our products are household kitchen goods intended for ordinary domestic use. Follow the care instructions on each product page. Knives and other sharp items must be kept away from children. We are not responsible for injury or damage caused by misuse, by use contrary to the care instructions, or by commercial use of products sold for domestic use.
8. Intellectual property
The Marble Pantry name, logo, site design and original written content are our property. You may not copy, reproduce or republish them without written permission. Product photography remains the property of the respective manufacturers and vendors.
9. Prohibited uses
You may not use the site to attempt unauthorised access, scrape or harvest data, upload malicious code, interfere with security features, or harass any person.
10. Third-party links and services
The site may link to or embed third-party content and services, including order-tracking services. We do not control and are not responsible for their content, accuracy or privacy practices.
11. Disclaimer of warranties
The site and its content are provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. This does not affect any statutory consumer rights you have that cannot be excluded.
12. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or related to your use of the site or any product is limited to the amount you paid for the product in question. We are not liable for indirect, incidental, special, punitive or consequential damages.
13. Indemnity
You agree to indemnify and hold harmless Scale Media LLC and its officers and employees from any claim arising out of your breach of these Terms or your violation of any law or third-party right.
14. Severability
If any provision of these Terms is found unlawful or unenforceable, that provision is severed and the remaining provisions stay in force.
15. Governing law
These Terms are governed by the laws of the State of Wyoming and the United States, without regard to conflict-of-law principles.
16. Changes to these terms
We may update these Terms at any time by posting a revised version on this page with a new "Last updated" date. Continuing to use the site after that constitutes acceptance.
